The following privacy notice applies to Conwy County Borough Council’s Legal Section, which sits within Law and Governance.

Purpose for Processing and Legal Basis

The Legal Section provide a number of services to internal client departments, external clients, Councillors and members of the public (contentious and non-contentious matters). The processing is necessary to deliver these services, which can be for any one of the following legal basis:

  • Necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • Necessary for compliance with a legal obligation
  • Necessary to protect the vital interests of a data subject or another person
  • Necessary for the purposes of legitimate interests pursued by the data controller or a third party
  • Necessary for the performance of a contract with the data subject
  • Voluntary consent of the data subject

  • Date of Birth

  • Methods of identification
  • Next of kin, name and contact details
  • Details of previous criminal convictions
  • Welfare assessments
  • Assessment reports
  • Health reports

How long will we hold your information

The Legal Section will retain and destroy your information in line with its Retention Schedule, which can be obtained from the contact details below. Depending on the type of matter it will be either 6 years, 12 years or 75 years after the file has closed.

Your Rights

You have the right to:

Access the information we hold about you – please request online or contact us as per the Contact Details below.

Request that we rectify any information about you that is incorrect - Simple inaccuracies, such as address changes will be made, depending on the purpose for use.  Records, including statements and opinions may not be changed, but there will be the option for you to provide a supplementary statement, which will be added to the file. 

Request that records we hold about you are erased - this may be limited dependent on the legal basis.

Restrict the use of the information we hold about you - if you have raised an objection, we may restrict processing of this information whilst your objection is investigated.

Request that any information that you have provided to us is given back to you in a format that you can give to another service provider if required – only relevant if the information you have provided relates to the performance of a contract.

Object to the use of your personal information, including automated decision making and profiling – your information will not be used for automated decision making or profiling.

Make a complaint – you can complain to the Information Commissioners Office if you are not satisfied with how the information held about you has been handled.  The contact details for the Information Commissioners Office are included on the Council’s full Privacy Notice
